Personal data: The National Commission for Information Technology and Freedoms wants to reassure about the COVID vaccine file

Remember, there was a controversy about the electronic file that the government should put in place in order to better monitor and manage The CoVid vaccination.

On the side of the National Commission for Information Technology and Freedoms, the structure provides accreditation for the implementation of the initiative. To do this, some recommendations have been made by the independent administrative authority to have a better control of the matter.

The issue of transparency is essential. Especially in a situation where skepticism reigns supreme. The personal data that will result from this through the implementation of the tracking file must be explicit and at best to allow to remove any amalgamation. And as we know this kind of subject is sensitive.

On December 25, the French government issued a decree to authorize the creation of a file that will follow the treatment of the vaccine. This treatment was called SI COVID vaccine. The file referred to here is supposed to match information collected about people who have been vaccinated or are programmed to be vaccinated. The aim is to be able to better organize the vaccination campaign as well as to be able to follow the procedures for supplying the vaccine. There is also interest in pharmacovigilance research and follow-up.

For its part, the National Commission for Information Technology and Freedoms responded to a letter sent to it by the Ministry of Health and Solidarity. The idea was to have as much information as possible about this initiative and the scope of personal data. The independent administrative authority, for its part, did not fail to provide some recommendations and recalled on several, in particular, the legislative aspect. The institution highlighted the fundamental distinction between personal data and health data. Personal data includes information that relates to the identity, personal information and social security number. Personal data also includes health data that may be the criteria for being eligible for the vaccine. These criteria are determined by the Ministry of Health. The National Commission for Information Technology and Freedoms wanted to recall that "these data are protected by medical secrecy and should only be processed by authorized persons and subject to professional secrecy."

According to the information on the file, the information that will be contained there will have a shelf life of 10 years. To the extent that people get vaccinated a new one, the shelf life can be up to 30 years.

People who will be entitled to this information include:

– Professionals responsible for making vaccines

– The CNAM

– The National Agency for drug safety and health products

– Treating physicians when they have the patient's consent.

The information that will be collected will be made anonymous so as not to attach identities to specific data. As the CNIL states, this data will indeed be available for: "Some staff from the National Public Health Agency (ANSP) and regional health agencies (ARS) to monitor vaccination coverage and organize the vaccination campaign. This data can also be shared with the Ministry of Health's Directorate of Research, Studies, Evaluation and Statistics (DREES) to establish statistics."
